Collin was Director General of customs from 1801 to 1812. The painting was commissioned in 1813 and is mentioned as being at the Château de Compiègne. Returned to the model during the Restauration. Gift of comte H. Collin de Sussy, son of the model, in 1853.

As he was in prison during the execution, he was not thus able to to see the event and so he drew it from eye-witness accounts.
